The City Manager recommends that the subject ordinance be adopted.
Five written approvals and seven written protests were originally received. None of the protests were within the 150 foot area. No additional protests have been received.
A simple majority vote will be necessary to adopt the subject ordinance.
6. ZONING: (C9-95-10) EVENCHIK - ALVERNON WAY, R-2 TO C-1 (SOUTHEAST CORNER OF ALVERNON WAY AND LEE STREET)

The City Manager recommends that the subject ordinance be adopted.
One written approval and two written protests were received. Two of the protests were within the 150-foot area representing an 11 percent protest to the south, and a 25 percent protest to the west.
A three-fourths majority vote will be necessary to adopt the subject ordinance.

12. ZONING: (C9-96-13) ARBOGAST - PIMA STREET, R-1 TO C-1 (CONTINUED FROM THE MEETING OF FEBRUARY 3, 1997)

(c) Request to rezone property on Pima Street, approximately 100 feet west of Sonoita Avenue. Applicant: Paul Lindsey, on behalf of Ben Arbogast. The preliminary development plan proposes the use of the property as an office and retail complex. The Planning Department recommends approval of C-1 zoning for the northern half of the site, and O-1 zoning for the southern half, subject to conditions as amended by the Zoning Examiner. The Zoning Examiner recommends approval of C-1 zoning for the entire site, subject to recommended staff conditions, excluding condition 1.a., and including the additional conditions listed in the Zoning Examiner’s Report dated November 15, 1996. The City Manager recommends approval of C-1 zoning for the northern half of the site, and O-1 zoning for the southern half of the site, subject to the following conditions as amended by the Zoning Examiner:
1. A development plan, in substantial compliance with the revised preliminary development plan submitted to the Zoning Examiner on October 31, 1996, to be submitted and approved in accordance with Section 5.3.8 of the LUC, including but not limited to:
a. DELETED.
b. The shielding or directing of outdoor lighting away from adjacent residential uses. Lighting fixtures should be as low in elevation as possible.
c. The design of signs to be compatible with the landscape plan and are to reflect the architectural style or theme of the proposed development.
d. Noise-generating uses, such as loading zones and dumpsters locations, shall be located a minimum of 50 feet from any adjacent residential zone boundary, and screened with a minimum 6-foot-high masonry wall and landscaping. Any outdoor loudspeakers shall be directed away from adjacent residential zoning and uses.
e. Construction of any required or proposed screen walls with graffiti resistant decorative materials such as tile, stone, brick, or textured brick/block; or cover walls with a coarse-textured material, such as stucco or plaster, or a combination of materials, and promote the use of colors found predominately in the natural desert landscape for exterior wall colors.
f. Enhancement of the visual appearance of any continuous solid mass, such as walls greater than 75 feet in length and 3 feet in height, by one or more of the following techniques: (1) vary the wall alignment (jog, curve, notch, or setback, etc.) and plant trees or shrubs in the voids created by the variations: (2) plant trees and shrubs, which are proportional in scale to the proposed wall, at least every 25 feet; (3) use two or more materials such as tile, stone, or brick or textured brick/block, to create a visually interesting design pattern on the proposed wall.
g. Limitation of one (1) access point onto Pima Street as shown on the revised preliminary development plan.
h. A minimum setback of 112 feet for the second story of the proposed two-story building from the east property line.
i. Inclusion of 24-inch box trees in the landscape buffer along the east property line and 24-inch box trees in the parking area adjacent to the proposed two-story building as shown on the revised concept plan.
j. Relocation of the dumpster a minimum of fifty (50) feet from any residentially developed property.
2. Recordation of the applicant’s submitted list of limited uses.
3. Incorporation of “Safe By Design” elements into the development plan through discussions with the Tucson Police design team.
4. Any encroachment into Alamo Wash floodplain will require submittal of a HEC-2 Analysis.
5. Submittal of a drainage report addressing detention/retention.
6. Access to the property to the south shall be dedicated as a perpetual right-of-way easement, unless legal access to that lot from a public street can be provided at another location.
7. Any relocation, modification, etc., of existing utilities, and/or public improvements necessitated by the proposed development, will be at no expense to the public.
8. Five years to comply with all Code requirements and conditions of rezoning.
Thirteen (13) approvals and ten (10) protests have been received. Four (4) protests are within the 150 foot area, representing a 61.5 percent protest by area to the north, and a 85.6 percent protest to the east.
A three-fourths vote of the Mayor and Council will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
13. ZONING: (C9-81-63) STRUBLE - AJO WAY, R-1 TO C-2 (SOUTHWEST CORNER OF AJO WAY AND VALLEY ROAD)
