5. ZONING: (C9-96-01) TACK ROOM - SABINO CANYON ROAD, SR TO C-1 (EAST SIDE OF SABINO CANYON ROAD APPROXIMATELY 2400 FEET NORTH OF TANQUE VERDE ROAD), CLARIFICATION OF CONDITION NO. 6 RELATING TO HOURS OF OPERATION

(a) Report from City Manager NOV24-97-740 WII

(b) Ordinance No. 8991 relating to zoning: Amending zoning district boundaries in the vicinity of the east side of Sabino Canyon Road approximately 2400 feet north of Tanque Verde Road in Case C9-96-01, Tack Room - Sabino Canyon Road.

The City Manager recommends the approval of the clarification of the rezoning condition number 6 and the adoption of the subject ordinance.

Twenty-three (23) approvals and six (6) protests were received. None of the protests are within the 150 foot area.

A simple majority vote will be necessary to adopt the subject ordinance.

6. PUBLIC HEARING: RICHLAND HEIGHTS EAST DISTRICT TRAFFIC IMPROVEMENT

(b) Hearing. One objection to the extent of the district was filed, which under provision of A.R.S. 48-579 requires a hearing.

(c) Report of Expiration of Protest Period.

(d) Resolution No. 17856. Resolution of the Mayor and Council of the City of Tucson, Arizona, overruling protests and denying objections to the extent of the assessment district, ordering the improvement known as the "Richland Heights East District Traffic Improvement," in the City of Tucson, Arizona, and ordering the publication of a notice of the passage of the resolution ordering the work, and inviting sealed bids for making the improvement, all in accordance with the provisions of Title 48, Chapter 4, Article 2, Arizona Revised Statutes, and amendments and supplements thereto.

7. PUBLIC HEARING: UNIVERSITY AREA PLAN AMENDMENT

(b) Hearing on a proposed amendment that would permit the conversion or removal of two houses on three lots fronting Sixth Street for commercial uses, and the removal of two houses on two lots fronting Martin Avenue south of Sixth Street for parking.

(c) Resolution No. 17876 relating to planing and zoning; amending the University Area Plan.

The City Manager recommends that requested plan amendment be denied.

8. PUBLIC HEARING: SAM HUGHES NEIGHBORHOOD PLAN AMENDMENT

(b) Hearing on proposed amendments that would permit parking on four contiguous lots (2506, 2508, 2516, and 2520 East Fifth Street) located on the southeast corner of Fifth Street and Tucson Boulevard; permit parking lot access across a south portion of the lot located at 2528 East Fifth Street; and to allow office, research and development, and retail uses on the west portions of two lots located at 529 and 521 North Forgeus Avenue.
