1A. EXECUTIVE SESSION: INITIATIVE PETITION NO. 1998-I001 - PROPOSED AMENDMENT TO CHAPTER XVI, SECTION 9 OF THE TUCSON CHARTER RELATING TO THE MANNER IN WHICH COUNCIL MEMBERS ARE ELECTED
(a) Report from City Manager AUG17-98-458 CITY WIDE
An executive session may be held for discussion or consultation for legal advice with the attorneys for the City of Tucson regarding Initiative Petition No. 1998-I001 pursuant to Arizona Revised Statutes Section 38-431.03(A)(3).
2. INITIATIVE PETITION NO. 1998-I001: PROPOSED AMENDMENT TO CHAPTER XVI, SECTION 9 OF THE TUCSON CHARTER RELATING TO THE MANNER IN WHICH COUNCIL MEMBERS ARE ELECTED (CONTINUED FROM THE MEETING OF AUGUST 3, 1998)
(a) Report from City Manager AUG17-98-453 CITY WIDE
(b) Resolution No. 18104 relating to elections; notice by the Mayor and Council of the City of Tucson, Arizona, to the citizenry thereof, declaring their future intent, at a point in time that complies with the requirements of the Arizona Constitution, to call a Special Election on Public Initiative Petition 1998-I001, for the purpose of submitting to the qualified electors thereof a question relating to amending the City Charter, Chapter XVI, Section 9 concerning the nomination and election of councilmembers by ward.
2A. ZONING: (C9-95-21) LEVIS - SWAN ROAD, SR TO R-3, PARTIAL ORDINANCE ADOPTION
(a) Report from City Manager AUG17-98-456 WII
(b) Ordinance No. 9108 relating to zoning: Amending zoning district boundaries in the vicinity of the west side of Swan Road, approximately 500 feet north of the New Fort Lowell Road alignment, in case C9-95-21 Levis - Swan Road, SR to R-3.
The City Manager recommends that the subject ordinance for the R-3 portion of the rezoning case be adopted.
Two (2) written approvals and forty-four (44) written protests were received for this case. Four (4) of the protests are located within the 150-foot notification area resulting in a six (6) percent protest by area to the west and a zero (0) percent protest to the south, east and north.
A simple majority vote will be necessary to adopt the subject ordinance.
2B. PLATS: (S98-011) FINAL PLAT - HACIENDA DEL RIO, LOTS 1 THROUGH 118 AND COMMON AREAS "A" AND "B" ( A RESIDENTIAL CLUSTER PROJECT)

(b) The City Manager recommends that the final plat be approved as presented. The applicant is advised that building/occupancy permits are subject to the availability of water/sewer capacity at the time of actual application.
2C. ASSURANCE AGREEMENT: HACIENDA DEL RIO, LOTS 1 THROUGH 118 AND COMMON AREAS "A" AND "B" (A RESIDENTIAL CLUSTER PROJECT) (S98-011)

(b) Resolution No. 18105 relating to planning: Authorizing the Mayor to execute an assurance agreement securing the completion of improvements required in connection with the approval of a final plat for the Hacienda Del Rio, Lots 1 thru 118, and Common Areas "A" and "B".
3. PUBLIC HEARING: BASIC CITY SERVICES - MEETING CURRENT AND FUTURE FACILITY AND SPACE NEEDS
