10. ZONING: (C9-99-19) GENESEE – OLD SPANISH TRAIL, SR TO R-1, ZONING EXAMINER'S REPORT

(c) This is a request by Ms. Linda Morales of the Planning Center, on behalf of the Genesee Company, to rezone approximately 10.93 acres from SR to R-1 zoning. The rezoning site is located on the south side of Old Spanish Trail approximately 1,000 feet southeast of the intersection of Old Spanish Trail and 22^nd Street. The preliminary development plan is for a 46 lot single-family residential subdivision utilizing the Residential Cluster Project option for a density of 4.2 units per acre. The Zoning Examiner and the Planning Department recommend approval of R-1 zoning, subject to certain conditions. The City Manager recommends approval of R-1 zoning, subject to the following conditions.

1. A subdivision plat, in substantial compliance with the Preliminary Development Plan and the Design Compatibility Report, is to be submitted for review and approval in accordance with Section 4.1.1 of the LUC, including, but not limited to:

a. All dwellings shall be one-story with a maximum building height of fifteen (15) feet.

b. A landscape buffer/setback area adjacent to Old Spanish Trail in excess of the scenic route requirements, in general compliance with the preliminary development plan, designed in such a way as to provide continuity with the landscape buffer/setback areas of the Village Green subdivision.

c. The tributary wash in the southern portion of the site shall be maintained as open space.

d. Recordation of the Dunham School Agreement.

2. The owner/developer shall dedicate right-of-way, per the Major Streets and Routes Plan, along the Old Spanish Trail frontage of the rezoning site.

3. The owner/developer shall install an interim southeast bound right turn lane and a center left turn lane on Old Spanish Trail at the entrance to the rezoning site with appropriate transitions and taper lengths. These improvements shall provide for the continuation of the existing bicycle facilities.

4. The owner/developer shall contribute funds to an escrow account to be used to cover the fair share costs of future typical permanent street improvements (pavement, curbs, sidewalks, etc.) in the vicinity of the site. An in-lieu contribution of $625.00 per lot is appropriate for this single-family subdivision.

5. A drainage report shall be submitted for review and approval, including retention/detention calculations/requirements.

6. Water harvesting techniques shall be incorporated into the development by conveying all rooftop drainage to designated water harvesting areas.

7. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls visible from the public right-of-way shall comply with the design requirements of the Scenic Corridor Zone (SCZ).

8. Any outdoor lighting shall be directed down and away from adjacent residential parcels and public roadways and be as low in elevation as possible.

9. An on-the-ground survey by a qualified archeologist shall be performed before any ground modification, and if any remains are found, a data recovery program approved by the Arizona State Museum shall be performed.

10. All areas designated as open space, including the wash on the south end of the property and the landscape buffer/setback area along Old Spanish Trail, shall be fenced off and protected prior to any on-site development activity.

11. The U. S. Fish and Wildlife Service guidelines regarding the Cactus Ferruginous Pygmy Owl shall be followed.

12. The Arizona Game and Fish Department guidelines regarding raptors, bats, gila monsters, and special status plants and animals shall be followed.

13. "Safe by Design" concepts shall be incorporated in the subdivision plat for review by the Tucson Police Department.

14. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.

15. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
