5. APPEAL: (S-00-001) APPEAL OF SIGN CODE ADVISORY AND APPEALS BOARD DECISION - 5425-5455 E. SPEEDWAY BOULEVARD, MCDONALD'S CORPORATION (CASE NO. S-99-30)

    ADDED (b) Applicant: Michael J. Grassinger, of The Planning Center, representing the McDonald's Corporation, and the appellant/owner,Wright-Craycroft L.L.C.

    This is an appeal of a decision made by the Sign Code Advisory and Appeals Board in Case No. S-99-30. On November 10, 1999 the Board denied the applicant's request for a variance. The requested variance would allow McDonald's to advertise on the top (81 square foot) cabinet of an existing 183.25 square foot nonconforming pole sign. The pole sign consists of three (3) different cabinets - the top cabinet is blank and the two bottom cabinets are used by Walgreen's. For purposes of the Tucson Sign Code, Walgreen's is classified as a retail use and McDonald's as a restaurant use. Tucson Code, Section 3-95, states that when a use changes from one occupancy category to another, all signs shall be brought into conformance with the current Sign Code. The applicant's request to the Board was for a variance from Tucson Code, Section 3-59(D), General Requirements and Limitations Sign C: "Freestanding Pole Sign" which restricts the size and height of freestanding signs. The applicant requested a variance to exceed (1) the size of a "freestanding pole sign" by 111.25 square feet and (2) the maximum height by 10.17 feet.

    AMENDED On December 10, 1999 the applicant requested that the Board reconsider its November 10, 1999 decision. On January 12, 2000, the Board held a public hearing for the submitted request for reconsideration. A motion was made and seconded to hear the reconsideration. The motion for reconsideration was denied 4-1; therefore, the request for reconsideration was not heard. On January 12, 2000, the Board scheduled a public hearing for the request for reconsideration. The motion for reconsideration failed; therefore, the request was not heard.

    The applicant is now appealing to the Mayor and Council and requests that the Board's decision be reversed and that a variance be granted. The requested variance from the size and height restrictions of a "Freestanding Pole Sign" would allow McDonald's to utilize the top (81 square foot) cabinet of the existing nonconforming pole sign.

    The City Manager recommends that the Mayor and Council consider the merits of the appeal and vote to uphold, reverse, or modify the decision of the Board.
