(c) Request to rezone approximately 1.67 acre site located on the southwest corner of Fairview Avenue and Roger Road, from MH-1 to C-2 zoning. Applicant: Planning Resources, on behalf of the property owners, Jim and Penelope Hunsberger. The preliminary development plan proposes a 24,000 square foot single-story building for "incubator" businesses and offices. The Planning Department and the Zoning Examiner recommend approval of C-2 zoning. The City Manager recommends approval of C-2 zoning, subject to the following conditions:

1. A development plan, in substantial compliance with the preliminary development plan and the Design Compatibility Report, is to be submitted and approved in accordance with Section 5.3.8 of the LUC, including, but not limited to:

a. Maximum of one access point on Roger Road and two access points on Fairview Avenue.

b. Maximum building height of twenty-eight (28) feet.

c. On-site vehicular linkages between the front and back of the building.

2. The owner/developer shall dedicate right-of-way, per the Major Streets and Routes Plan, along Roger Road and Fairview Avenue in the form approved by the Department of Transportation, as required.

3. The owner/developer shall install seventeen (17) feet of pavement and a curb, and a six foot wide sidewalk along the Roger Road and Fairview Avenue frontage of the project. Owner/developer shall coordinate with the Transportation Department to ensure that the design of the improvements conform to the ongoing design for the Fairview/Roger Intersection Improvement project.

4. A drainage report shall be submitted and approved, including detention, 5-year threshold and mitigation of offsite and onsite flows.

5. The detention/retention basin shall be located along the existing lowest area with the outflow released in the same manner as existing prior to development.

6. Water harvesting techniques shall be utilized by conveying all rooftop, parking area access lane (PAAL), and parking area drainage to designated water harvesting areas.

7. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. Those screen walls visible from the public right-of-way and along the west property line shall incorporate one of the following decorative materials: (a) tile, (b) stone, (c) brick, (d) textured brick/block, (e) a coarse-textured material such as stucco or plaster, or (f) a combination of the above materials. In addition, any continuous wall greater than 75 feet in length and 3 feet in height shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.

8. All outdoor lighting shall be directed down and away from residential parcels and public roadways and be as low in elevation as possible.

9. All new dumpsters and loading spaces shall be placed at least fifty (50) feet from residentially developed property and screened from view of all adjacent streets and public roadways.

10. Coolers, air conditioners, solar panels and other mechanical equipment shall be concealed from view from streets and nearby structures.

11. An on-the-ground survey by a qualified archeologist shall be performed before any ground modification, and if any remains are found, a data recovery program approved by the Arizona State Museum shall be performed. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

12. "Safe by Design" concepts shall be incorporated in the development plan for review by the Tucson Police Department.

13. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.

14. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.

Five (5) written approvals and no written protests have been received.

A simple majority vote will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.

8. ZONING: (C9-00-31) TUCSON DEVELOPMENT, LLC - I-10, O-3 TO C-2, ZONING EXAMINER'S REPORT

(c) Request to rezone approximately 2.56 acres located on the west side of Interstate 10 approximately 600 feet north of Fort Lowell Road, from O-3 to C-2 zoning. Applicant: Tucson Development, LLC. The preliminary development plan proposes a 84,250 square-foot office/warehouse project on 4.43 acres. The Planning Department recommends approval of C-2 zoning, allowing the wall down the center of the project with the condition requiring a gate and pedestrian access through the wall. The Zoning Examiner recommends approval of C-2 zoning and allowing the proposed wall down the center of the project. The City Manager recommends approval of C-2 zoning, subject to the following conditions:

1. A development plan, in substantial compliance with the preliminary development plan and the Design Compatibility Report, is to be submitted and approved in accordance with Section 5.3.8 of the LUC, including, but not limited to:

a. A pedestrian path connecting the north and south rear buildings including a gate through the wall down the center (east to west) of the project.

b. Integrated parking and access.

c. At least ten (10) feet of landscaping provided within the property on the east property line.

2. A drainage report shall be submitted and approved, including retention/detention calculations/requirements and any other requirements as provided by the Engineering Floodplain staff.

3. Access shall be approved by the Arizona Department of Transportation.

4. Water harvesting techniques shall be utilized by conveying all rooftop, parking area access lane (PAAL), and parking area drainage to designated water harvesting areas. Water harvesting shall be provided adjacent to all buildings.

5. All buildings shall be a minimum of five hundred (500) feet from the top of the east bank of the Santa Cruz River.

6. A subsurface survey by a qualified archeologist shall be performed before any ground modification, and if any remains are found, a data recovery program approved by the Arizona State Museum shall be performed. Archeological/cultural remains encountered during ground modification activities shall be mitigated in accordance with guidelines provided by the Arizona State Museum.

9. ZONING: (C9-94-18) SOUTHWEST VALUE PARTNERS - TUCSON BOULEVARD, R-1 TO P-1 AND I-1, TIME EXTENSION AND ORDINANCE ADOPTION

(b) Ordinance No. 9509 relating to zoning: Amending Ordinance 9494, time extension for completion of conditions in Case C9-94-18, Southwest Value Partners - Tucson Boulevard, R-1 to P-I and I-1 (Ward 5); and declaring an emergency.

The Zoning Examiner's Report for this case was originally scheduled for today's agenda. The City Clerk has received a request that the Zoning Examiner's Report be considered at a public hearing. Because this case expires January 22, 2001, a time extension is necessary to allow time to provide the required public hearing notice. Approval of this item will grant a time extension to March 26, 2001.

The City Manager recommends Mayor and Council grant a time extension in rezoning case C9-94-18 Southwest Value Partners - Tucson Boulevard, to March 26, 2001, and adopt the ordinance presented.

10. ZONING: (C9-00-12) KEA - GRANT ROAD, C-1 TO C-2, ORDINANCE ADOPTION AND CHANGE OF CONDITION

(b) Request to rezone property located on the northwest corner of Grant Road and Geronimo Avenue. Applicant: Jack Fitzgerald on behalf of the property owner, Kathleen Kea. The approved development plan is for a consignment sales used car lot on 0.55 acres. The City Manager recommends the adoption of the ordinance presented. To improve clarity regarding the required irrevocable offer to dedicate right-of-way for Grant Road, condition #2 as listed in the ordinance presented, has been changed from that originally approved by Mayor and Council as follows. Added text is underlined, deleted text is strikethrough.

2. The owner/developer shall provide an irrevocable offer to dedicate right-of-way for Grant Road, up to a maximum of 20.5 feet per the Major Streets and Routes Plan, including a 25-foot spandrel at the corner of Geronimo Avenue, per the ultimate right-of-way plan as determined by the future roadway design.

(c) Ordinance No. 9510 relating to zoning: Amending zoning district boundaries in the area located at the northwest corner of Grant Road and Geronimo Avenue in Case C9-00-12, Kea - Grant Road, C-1 to C-2 (Ward 3).

Two written approvals and four written protests have been received for this case. All the protests lie within the 150 foot protest area resulting in a protest by area of 73.34 percent to the east, 10.76 percent to the north, and zero percent to the south and west.

A three-fourths majority vote will be necessary to adopt the ordinance presented.
