7. ZONING: (C9-01-13) KHANDHAR - MIRACLE MILE, MH-1 TO C-2, ZONING EXAMINER'S REPORT

(c) Request to rezone approximately 1.18 acres of property located 600 feet north of Miracle Mile and 323 feet west of Flowing Wells Road, from MH-1 to C-2. Applicant: Asta Planning and Zoning Company on behalf of the property owner Ramesh Khandhar. The preliminary development plan is for 78,824 square feet of personal self-storage on 3.88 acres.
The Planning Department and Zoning Examiner recommend approval of C-2 zoning. The City Manager recommends approval of C-2 zoning, subject to the following conditions.
1. A development plan covering the entire 3.88 acre site, in substantial compliance with the preliminary development plan dated August 23, 2001, and the Design Compatibility Report, is to be submitted and approved in accordance with Section 5.3.8 of the LUC, including, but not limited to:
a. Building setbacks, canopy trees, and screening as required by the Land Use Code without variance along the west property line.
b. Building setbacks, and screening as required by the Land Use Code without variance along the north property line. A minimum of one tree for every 20 feet of landscape border on the north property line.
c. Vehicular access limited to Miracle Mile.
2. The owner/developer shall dedicate or verify the existence of, right-of-way per the Major Streets and Routes Plan, along Miracle Mile.
3. A six (6) foot wide sidewalk shall be installed along the Miracle Mile frontage of the property.
4. Curb replacement on Miracle Mile shall be required for all existing curb cuts that are no longer needed along the site frontage, and curb radius returns of twenty-five (25) feet or greater shall be required for the proposed access driveway.
5. A detailed hydrology/hydraulics report shall be submitted and approved. The report shall address the detention/retention analysis, which includes onsite storage of the 5-year retention volume from the entire 3.88-acre parcel.
6. Water harvesting techniques shall be utilized by first directing all rooftop and drive/access runoff lanes into landscaped areas prior to discharging in a channel or other drainage infrastructure.
7. Any required or proposed masonry screen walls shall be constructed of, or painted with, graffiti-resistant materials. The south 100 feet of the west screen wall and the west 41 feet of the south screen wall shall be constructed of split face block. The remaining 510 feet of the west screen wall shall be constructed with a minimum of one row of split face block.
8. Any continuous wall greater than 75 feet in length and 3 feet in height visible from the public right-of-way shall vary the wall alignment (jog, curve, notch, or setback, etc.) and include trees or shrubs in the voids created by the variations.
9. Outdoor security lighting shall be shielded or hooded so as not to illuminate or produce glare on adjacent residential uses. Lighting shall be a maximum of 15 feet high, measured to the light source, except within 60 feet of the right-of-way line of Miracle Mile.
10. All new dumpsters and loading spaces shall be placed at least fifty (50) feet from residentially zoned or developed property.
11. On-site resident management and 24-hour gated access is required.
12. If archaeological features are found during project construction, testing and data recovery will be completed as needed. Copies of testing plans, testing reports, data recovery plans and final reports shall be submitted to and approved by the City Historic Preservation Office prior to construction work commencing. If, during construction, human remains and associated burial items are discovered, ground disturbing activities in the vicinity of the discovery will cease, the discovery site will be secured, and the Arizona State Museum will be immediately notified as required under A. R. S. 41-865.
14. Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development shall be at no expense to the public.
15. Five years are allowed in which to comply with all Code requirements and conditions of rezoning.
Three (3) approvals and zero protests have been received.
A simple majority vote will be necessary to adopt an ordinance rezoning the subject property once the conditions of rezoning are met.
8. ZONING: (C9-00-31) TUCSON DEVELOPMENT LLC - I-10, O-3 TO C-2, ORDINANCE ADOPTION

(b) Request to rezone property located on the west side of I-10, approximately 600 feet north of the Fort Lowell Road alignment, from O-3 to C-2. Applicant: Tucson Development LLC, the property owner. The approved development plan is for a 73,000 square foot commercial storage building and 7,100 square foot office building on 4.43 acres. The City Manager recommends approval of the ordinance presented.
(c) Ordinance No. 9610 relating to zoning: amending the zoning district boundaries in the area located on the west side of I-10, approximately 600 feet north of the Fort Lowell Road alignment in Case C9-00-31, Tucson Development LLC - I-10, O-3 to C-2. (Ward 1); and setting an effective date.
Zero approvals and zero protests have been received.
A simple majority vote will be necessary to adopt the ordinance presented.
