Our nation is grounded on the principle that the rule of law is the ultimate arbiter which ensures the stability of our government. The Constitution was adopted as the framework for maintaining that stability. The 25th Amendment is embedded in that document to provide for a transition of power in times when the President is incapable of carrying out the duties of the office.
When today began, we anticipated a series of Constitutionally protected maneuvers on the Senate floor through which members of that body would raise their objections to carrying out the will of the electors, the people. And yet, the ultimate outcome has never been in doubt. President-elect Biden will be sworn in, per the will of the people, on January 20th.
Throughout the day, President Trump has openly encouraged supporters as they stormed the Capitol, created havoc throughout D.C., vandalized the building, and caused the confirmation of our electoral process to be suspended. One woman was killed, and scores others injured in a day that can only be described as domestic terrorism. With his complicity in these activities, President Trump has shown he is incapable of finishing out his term in office.
Section 4. Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
The “principal officers of the executive departments” are the members of the sitting cabinet. The 25th Amendment to the U.S. Constitution gives the Vice President and the 15 members of the Cabinet the authority to vote to remove the sitting President. They should immediately take that action and begin the process of removal. The nation cannot allow President Trump this platform for another 14 days. The potential for both domestic and international calamity is too great.
Vice President Pence and the Cabinet must immediately invoke the 25th Amendment and begin the process of the removal of Donald J. Trump as President of the United States. Anything less constitutes a threat to the principles on which our nation is founded.
